Reconceptualizing Environmental Law
Problems
The onset of the Anthropocene marks a critical turning point in Earth’s history, highlighting the profound and accelerating impacts of human activity on the ecosphere. This era has driven the planet into a state of crisis, pushing ecological systems beyond their critical limits. Yet, environmental law and governance—both globally and nationally—remain inadequate in addressing the scale and urgency of this challenge.
At the international level, environmental legal frameworks are fragmented, reactive, and lack a cohesive normative foundation. This has resulted in poor coordination, limited synergy among sectoral regulations, and ineffective responses to the worsening ecological crisis.
In Indonesia, environmental degradation continues to pose a major threat despite the existence of various legal instruments. In recent years, the implementation and enforcement of environmental law have suffered setbacks, weakening the country’s capacity to address pressing environmental challenges.
Our Approach
IOJI is advocating for the reconceptualization of environmental law to respond to the realities of the Anthropocene era—a time in which human activity has become the dominant force shaping the planet’s ecosystems. Existing legal frameworks are no longer sufficient to address the scale of the global environmental crisis.
We believe it is necessary to rethink Indonesia’s environmental laws to ensure they are capable of addressing the increasingly urgent and complex ecological challenges of the future. Our approach emphasizes the development of legal frameworks that reflect the interconnected nature of today’s planetary crisis.
One of the key areas IOJI focuses on is the protection and regulation of marine environments, which are under growing threat from global warming, pollution, and other human-driven impacts. These challenges require legal reforms that go beyond traditional approaches, supporting more effective, integrated action to mitigate and manage anthropogenic harm.
By promoting legal reform rooted in the context of the Anthropocene, IOJI works to strengthen Indonesia’s capacity for sustainable and equitable ocean governance.
