Deteksi dan analisis yang dilakukan oleh Indonesia Ocean Justice Initiative (IOJI) selama periode April hingga Agustus 2023 berfokus pada aktivitas-aktivitas yang patut diduga merupakan kegiatan penangkapan ikan secara ilegal (illegal fishing), pencemaran berupa minyak (oil pollution) oleh kapal-kapal tanker dan riset ilmiah kelautan tanpa izin. Wilayah deteksi dugaan illegal fishing adalah Laut Natuna Utara (LNU) dan Laut Arafura. Sedangkan area deteksi oil pollution adalah perairan timur Johor dan perairan sekitar Pulau Bintan. Untuk riset kelautan, IOJI mendeteksi aktivitas kapal riset Tiongkok di LNU dan wilayah yurisdiksi beberapa negara tetangga Indonesia.
Secara umum, deteksi terhadap wilayah LNU menunjukkan masih terdapat kapal ikan Vietnam yang diduga kuat melakukan kegiatan illegal fishing. Terdapat 28 kapal yang berhasil dideteksi dengan citra satelit dan 7 kapal dengan Automatic Identification System (AIS). Di Laut Arafura, IOJI mendeteksi aktivitas 2 kapal ikan Tiongkok bernama Fu Yuan Yu 611 dan Fu Yuan Yu 612.
Mengenai pencemaran laut berupa tumpahan minyak, deteksi IOJI menunjukkan bahwa aktivitas ship to ship transfer sangat marak terjadi di perairan timur Johor, Malaysia dan terdapat jejak oil pollution yang pada akhirnya mencemari wilayah perairan dan pesisir pantai Indonesia (transboundary pollution).
Metodologi
Pengumpulan data dan informasi mengenai pergerakan kapal-kapal di wilayah yurisdiksi dan perairan Indonesia dilakukan melalui teknologi Automatic Identification System (AIS) dan citra satelit. Data AIS diperoleh dari MarineTraffic dan citra satelit diperoleh dari Sentinel-2 milik European Space Agency (ESA). Analisis dilakukan terhadap pola pergerakan kapal dan hal-hal lain yang relevan untuk menilai adanya dugaan pelanggaran terhadap kedaulatan dan hak berdaulat Indonesia. Data dan informasi mengenai dugaan pencemaran laut diperoleh melalui teknologi perangkat lunak Cerulean yang dikembangkan oleh SkyTruth. Cerulean adalah perangkat lunak yang menggunakan algoritma computer vision dan memiliki kemampuan mendeteksi pencemaran laut dari tumpahan minyak, menggunakan data citra satelit. Citra satelit berasal dari Sentinel-1 milik European Space Agency (ESA).
Dasar hukum yang digunakan dalam analisis ini adalah United Nations Convention on the Law of the Sea (UNCLOS), instrumen hukum internasional lainnya yang relevan, dan peraturan perundang-undangan nasional yang berlaku di Indonesia.
Dugaan Illegal Fishing di Laut Natuna Utara
Pada bagian ini akan digunakan terminologi “wilayah sengketa” dan “wilayah non-sengketa”. Kedua terminologi digunakan dengan pertimbangan peta titik koordinat batas Zona Ekonomi Eksklusif Indonesia dan Vietnam (sebagaimana telah disepakati oleh kedua kepala negara pada Desember 2022) belum secara resmi dipublikasikan oleh Pemerintah Indonesia.
Pada tanggal 10 Mei 2023, Menteri Luar Negeri Retno Marsudi memberikan pernyataan berkaitan dengan perjanjian ZEE Indonesia-Vietnam, “[r]egarding the signing or the conclusion of negotiations on the EEZ between Indonesia and Vietnam which have been signed, the two leaders agreed that the implementing arrangement and ratification process should be completed soon. In addition, the President also conveyed that the MoU on marine and fisheries is to be resolved immediately.” Pernyataan ini mengindikasikan bahwa peta resmi mengenai batas ZEE Indonesia-Vietnam masih belum dapat dipublikasikan.
“Wilayah sengketa” merujuk pada area di antara garis batas landas kontinen Indonesia-Vietnam ke utara sampai pada garis klaim terluar ZEE oleh Indonesia di LNU. Sedangkan “wilayah non-sengketa” adalah area di sebelah selatan garis batas landas kontinen Indonesia-Vietnam ke arah laut teritorial Indonesia. Gambar berikut menunjukkan “wilayah sengketa” dan “wilayah non-sengketa”.

Wilayah Non Sengketa
Pada periode April hingga Agustus 2023, deteksi AIS menunjukkan terdapat 28 kapal ikan Vietnam yang beroperasi di wilayah non-sengketa tepatnya pada koordinat 105.96 BT – 109.76 BT dan 5.19 LU – 6.27 LU. Informasi detail mengenai kapal-kapal tersebut terdapat pada Tabel 1 (terdapat 16 kapal) dan Tabel 2 (terdapat 12 kapal). Sebagian besar kapal-kapal tersebut baru terdeteksi pada periode pendeteksian kali ini. Artinya sebagian besar kapal-kapal tersebut bukan repeated offenders.

Damian C. Brady dari University of Maine menjelaskan kecepatan ideal kapal pair trawl saat beroperasi yaitu, “Towing speeds between 2.5 and 4.0 knots are possible, with a norm of about 2.8 knots and fuel consumption can be better than for an equivalent net towed by a single vessel.” Kajian Sea Fish Technology juga menyebutkan bahwa untuk kapal pair trawl, “Towing speed is usually between 2.5 and 3.5 knots depending on target species and conditions etc.”
Gambar 2 berikut ini merupakan plot pada peta terhadap koordinat kapal-kapal pada Tabel 1 untuk memperlihatkan lintasan historis kapal keluar-masuk wilayah non-sengketa di LNU.

Selain deteksi melalui AIS, melalui citra satelit IOJI menemukan terdapat kapal-kapal Vietnam yang tidak menyalakan AIS yang juga beroperasi di wilayah non-sengketa sebagaimana gambar berikut.

Jika dilihat dengan menggunakan skala, jarak antar kapal di Gambar 3 di atas adalah sekitar 300-400 meter. Ini sesuai dengan deskripsi pair trawling fishing technique, “The distance apart of the two vessels can vary depending mainly upon the depth of water and the target species, but is usually in the region of 300 – 400 metres.”

Tren data deteksi aktivitas kapal ikan Vietnam di wilayah non-sengketa LNU sejak Maret 2021 sampai Agustus 2023 adalah sebagai berikut:

IOJI mengamati terjadi penurunan jumlah aktivitas kapal ikan Vietnam di wilayah non sengketa pada 6 (enam) bulan terakhir di tahun 2023 jika dibandingkan dengan figur bulan Januari-Juni pada tahun 2021 dan 2022. Perbandingan Year on Year (YoY) angka intrusi pada bulan April-Mei-Juni tahun 2021 hingga 2023 juga mengalami penurunan.
Namun demikian kenaikan kembali terjadi pada bulan Juli 2023 dan Agustus 2023. Deteksi AIS menunjukkan terdapat 19 kapal Vietnam beroperasi di wilayah non-sengketa LNU. Selanjutnya, pada bulan Agustus 2023, deteksi AIS dan citra satelit menunjukkan 50 kapal diduga kuat kapal ikan Vietnam beroperasi di wilayah non-sengketa LNU. Secara lebih rinci dijelaskan di bawah ini.
Kapal Berbendera Non-Vietnam yang Berangkat dari Vietnam Diduga Kuat Melakukan Illegal Fishing di LNU Dengan Dikawal Kapal Vietnam Coast Guard
Pada bulan Juli 2023, IOJI mendeteksi AIS kapal-kapal ikan yang berangkat dari Pelabuhan Vung Tau (Vietnam) namun menggunakan nomor MMSI yang prefiksnya bukan negara Vietnam (Prefiks MMSI Vietnam adalah 574). Kapal-kapal ini kemudian beroperasi di wilayah non sengketa LNU. Intrusi tersebut kembali berulang pada bulan Agustus 2023. Tabel berikut menyajikan informasi kapal-kapal dimaksud.

IOJI mendeteksi data AIS kapal Vietnam Coast Guard dengan nomor lambung 2010 (VCG-2010 atau CSB 2010) yang posisinya berdekatan dengan kapal-kapal pada tabel di atas pada 17 Juli 2023. AIS kapal VCG-2010 tidak lagi dapat dideteksi setelah tanggal 17 Juli 2023.

Data AIS menunjukkan setidaknya 7 (tujuh) kapal ikan beroperasi dari tanggal 17 hingga 25 Juli 2023 di Laut Natuna Utara yang diduga disertai oleh keberadaan kapal Vietnam Coast Guard di dekatnya.
Track pergerakan kapal VCG-2010 dan ke tujuh kapal sebagaimana tercantum pada tabel 2 tersaji pada Gambar 7 dan Gambar 8 berikut ini.

Berdasarkan penelusuran, ditemukan informasi bahwa Vietnam memang memberikan izin bagi kapal ikan asing untuk beroperasi di perairan Vietnam. Hal ini diatur dalam Law on Fisheries No. 18/2017/QH14 and Decree No. 26/2019/ND-CP of the Government Regulating a number of articles and measures to implement the Fisheries Law. Izin bagi kapal ikan asing terdapat di Section 3 Law on Fisheries dan Section 2 Decree No. 26/2019/ND-CP.
Pada tahun 2016, Ditjen PSDKP KKP pernah menangkap kapal ikan berbendera Malaysia yang melakukan illegal fishing di LNU dan KKP menyebutkan bahwa pemasangan bendera Malaysia adalah “modus untuk mengelabui petugas di lapangan”. Pada tahun 2018, BAKAMLA RI juga pernah menangkap kapal berbendera Malaysia karena illegal fishing. Dari pemeriksaan diketahui seluruh awak kapal berkewarganegaraan Vietnam.

Berikut ini adalah beberapa contoh gambar yang diolah berdasarkan citra satelit memperlihatkan deteksi KIA Vietnam dengan alat tangkap pair trawl.
Wilayah Sengketa
Di wilayah sengketa LNU, deteksi AIS menunjukkan terdapat ratusan kapal ikan Vietnam yang beroperasi. Pada bulan April, Mei, Juni, Juli dan Agustus 2023 secara berturut-turut terdeteksi 177 kapal, 186 kapal, 149 kapal, 185, dan 214 kapal. Gambar di bawah menunjukkan salah satu contoh deteksi AIS tentang maraknya KIA Vietnam di wilayah sengketa LNU (Juli 2023).

Grafik pada Gambar 11 berikut ini menunjukkan tren jumlah KIA Vietnam yang terdeteksi di wilayah sengketa sampai dengan Agustus 2023. Dalam 6 bulan terakhir, jumlah kapal yang terdeteksi meningkat di wilayah sengketa LNU.

Vietnam Fisheries Surveillance Resources
Selain kapal ikan, IOJI juga mendeteksi keberadaan kapal Vietnam Fisheries Resource Surveillance (VFRS) berpatroli di sepanjang garis batas landas kontinen Indonesia-Vietnam. Setidaknya ada 4 (empat) kapal VFRS terdeteksi pada periode April hingga Juni 2023. Keempat kapal VFRS tersebut berpatroli selama 8 (delapan) minggu. Tabel dan gambar berikut menjelaskan secara rinci tentang 4 kapal VFRS dimaksud. Kapal-kapal tersebut berada di posisi stasioner yang jarang bergeser dari posisinya selama berpatroli.

Dugaan Illegal Fishing di Laut Arafura
Berdasarkan AIS, sejak tanggal 27 Juni 2023 terdeteksi 2 (dua) kapal ikan berbendera Tiongkok bernama Fu Yuan Yu 611 dan Fu Yuan Yu 612 di ZEE Indonesia, Laut Arafura dekat dengan perbatasan Indonesia-Australia. Kapal dimaksud sudah 1 (satu) bulan berada di wilayah tersebut. Tidak terdapat informasi lebih detail mengenai kapal-kapal tersebut, seperti nomor IMO, pemilik kapal, ukuran kapal, dan sebagainya. Keterbatasan informasi deteksi tersebut mirip pendeteksian kapal ikan Fu Yuan Yu 831 di ZEE Indonesia di perbatasan Indonesia-Timor Leste-Australia pada 2017 yang hanya sebatas nama kapal, nomor MMSI, dan lintasan kapalnya saja (Gambar 15). Kapal ikan Fu Yuan Yu 831 berhasil ditangkap oleh KKP pada 29 November 2017 dan ditahan di Kupang karena terbukti melakukan aktivitas illegal fishing di ZEE Indonesia, WPP 573.
Lokasi kegiatan 2 kapal ini berada pada koordinat -09° 21′ 03.7″ LS hingga -08° 39′ 53.1″ LS, dan 131° 45′ 12.7″ BT hingga 132° 31′ 01.5″ BT. Lokasi tersebut masuk pada WPP 718. Kecepatan rata – rata kapal-kapal tersebut adalah 1.79 knot sejak 27 Juni 2023. Artinya, kapal selalu dalam kecepatan rendah. Lintasan kapal adalah lintasan mondar-mandir yang mengindikasikan aktivitas penangkapan ikan.
Gambar 13 dan Gambar 14 di bawah ini menunjukkan lintasan kapal Fu Yuan Yu 611 dan 612 yang diduga kuat melaksanakan kegiatan penangkapan ikan di WPP NRI 718. Gambar 14 menampilkan informasi kecepatan dan lintasan kapal Fu Yuan Yu 612 yang diperbesar untuk memberikan gambaran pergerakan kapal mondar-mandir dengan kecepatan rata-rata rendah (kurang dari 5 knot).

Operasi Penangkapan Kapal Ikan Vietnam oleh BAKAMLA, KKP dan Polairud POLRI
IOJI mengapresiasi KKP dan Bakamla yang telah melakukan penegakan hukum terhadap kapal ikan Vietnam yang melakukan illegal fishing di ZEE Indonesia. Penangkapan dilakukan oleh BAKAMLA RI dilakukan oleh Kapal Negara Marore-322 terhadap 1 (satu) kapal Vietnam di LNU pada 11 Agustus 2023. Pada April 2023, KKP juga menangkap penangkapan 1 (satu) kapal ikan Vietnam di LNU. Pada 26 Agustus 2023, Polairud POLRI menangkap 2 (dua) kapal ikan Vietnam di LNU. Sejalan dengan analisis IOJI, penangkapan tersebut dilakukan saat kedua kapal ikan Vietnam tersebut dikawal oleh kapal Vietnam Coast Guard di LNU.
