Ancaman Keamanan Laut dan Illegal Fishing Periode Oktober – Desember 2022

Pendahuluan

Kertas analisis yang disusun tim Indonesia Ocean Justice Initiative (IOJI) ini membahas mengenai gangguan keamanan maritim di wilayah yurisdiksi dan perairan Indonesia yang terjadi pada Kuartal IV tahun 2022. Area yang menjadi fokus analisis adalah Laut Natuna Utara (LNU) dan Laut Arafura.

Salah satu perkembangan terkini terkait kemaritiman Indonesia adalah kesepakatan garis batas Zona Ekonomi Eksklusif (ZEE) Indonesia dan Vietnam yang berhasil dicapai pada bulan Desember 2022 walaupun Pemerintah Indonesia hingga saat ini belum secara resmi memublikasikan garis ZEE dimaksud dalam bentuk gambar pada peta wilayah. Oleh karena itu, pada bab analisis pembahasan mengenai LNU, gambar peta dan garis batas maritim yang kami gunakan adalah garis landas kontinen Indonesia-Vietnam Tahun 2003 dan batas klaim unilateral ZEE Indonesia sebelum kesepakatan ZEE Indonesia-Vietnam pada Desember 2022.

Secara umum, gangguan keamanan maritim yang terdeteksi pada periode ini adalah: (i) dugaan kegiatan illegal fishing di LNU dan Laut Arafura; (ii) operasi/patroli kapal Vietnam Fisheries Resource Surveillance (VFRS) di sepanjang garis landas kontinen Indonesia-Vietnam; dan (iii) pergerakan kapal China Coast Guard (CCG) 5901 di sisi timur laut dari LNU. Hal lainnya yang patut menjadi perhatian Pemerintah RI adalah operasi kapal-kapal ikan Indonesia di perairan Papua New Guinea, yang akan dibahas pada bagian akhir kertas analisis ini.

Metodologi

Pengumpulan data dan informasi mengenai pergerakan kapal-kapal di wilayah yurisdiksi dan perairan Indonesia dilakukan melalui teknologi Automatic Identification System (AIS) dan citra satelit. Data AIS diperoleh dari platform MarineTraffic. Sedangkan data citra satelit diperoleh dari Sentinel-2 milik European Space Agency (ESA). Analisis dilakukan terhadap pola pergerakan kapal dan hal-hal lainnya yang relevan untuk menilai terjadinya dugaan pelanggaran terhadap kedaulatan dan hak berdaulat Indonesia. Dasar hukum yang digunakan dalam analisis ini adalah United Nations Convention on the Law of the Sea (UNCLOS), instrumen hukum internasional lainnya yang relevan, peraturan perundang-undangan yang berlaku di Indonesia, serta berbagai literatur terkait lainnya.

Deteksi AIS

Area deteksi di LNU adalah ZEE non-sengketa. Untuk menghasilkan analisis yang valid, berbagai data AIS yang berhasil dikumpulkan di area tersebut “disaring” dengan 2 (dua) metode: (i) AIS kapal ikan dengan 3 digit pertama nomor MMSI 574, yang menandakan kapal tersebut berbendera Vietnam; (ii) AIS kapal (tidak terbatas kapal penangkap atau pengangkut ikan) yang berada di dalam wilayah ZEE Indonesia dalam jangka waktu tertentu dan kapal dimaksud berangkat dari pelabuhan yang berada di Vietnam. Hasil data yang telah diseleksi kemudian disaring untuk menghilangkan AIS spoofing.

Dengan metode tersebut di atas, IOJI berhasil mengumpulkan informasi kapal ikan Vietnam di ZEE non-sengketa LNU yang diduga melakukan kegiatan illegal fishing sebagaimana pada tabel berikut:

Kesebelas kapal ikan Vietnam di atas beroperasi di ZEE non-sengketa LNU selama 1 hingga 20 hari dengan kecepatan 2 – 4 knot (low speed). Kombinasi deteksi kecepatan pada AIS dengan analisis data citra satelit (lihat Sub-bab 1.2. di bawah) menghasilkan dugaan kuat bahwa kapal-kapal Vietnam ini beroperasi dengan alat tangkap pair trawl. Kecepatan 2-3 knot untuk kapal pair trawl adalah kecepatan ideal untuk menarik jaring pair trawl. Gambar perlintasan kapal-kapal tersebut saat terdeteksi Marine Traffic, dapat diakses melalui tautan berikut ini.

Deteksi Dengan Citra Satelit

Dengan teknologi citra satelit, IOJI berhasil mendeteksi keberadaan kapal ikan Vietnam pada bulan Oktober 2022. Pada bulan November dan Desember 2022, tutupan awan yang cukup tebal menyebabkan citra satelit yang tersedia tidak dapat memberikan gambaran kapal-kapal ikan Vietnam secara jelas.

Scene citra satelit tanggal 6 Oktober 2022 berhasil menangkap citra 18 kapal ikan asing (KIA). Selanjutnya, scene citra satelit pada tanggal 19 Oktober 2022 berhasil menangkap citra 24 kapal (KIA).

Titik-titik koordinat lokasi kapal yang dideteksi dengan citra satelit dapat diunduh melalui tautan berikut ini. Jumlah kapal ikan Vietnam yang terdeteksi berdasarkan citra satelit lebih banyak daripada jumlah kapal ikan Vietnam yang terdeteksi berdasarkan AIS. Hal ini disebabkan lebih banyak kapal ikan Vietnam yang tidak menggunakan AIS dibandingkan kapal ikan yang menggunakan AIS.

Gambar citra satelit di bawah ini menunjukkan pergerakan objek yang diduga kuat merupakan 2 pasang kapal ikan Vietnam dengan alat tangkap pair trawl pada bulan Oktober 2022 di ZEE LNU non-sengketa.

Lokasi Kapal-Kapal Ikan Vietnam (overlay data AIS dan citra satelit)

Beberapa gambar di bawah ini menunjukkan lokasi kapal-kapal ikan Vietnam yang terdeteksi dengan AIS dan citra satelit pada bulan Oktober, November dan Desember 2022.

Mengacu pada Gambar 2, 3 dan 4 di atas, nampak jelas bahwa operasi kapal ikan Vietnam terlihat bergerak semakin ke arah selatan mendekati Pulau Natuna menjelang akhir tahun 2022. Berdasarkan AIS, jarak terdekat kapal-kapal tersebut dari pulau terluar adalah sekitar 47 mil laut.

IOJI juga menerima informasi bahwa nelayan Natuna mendapati 6 kapal ikan Vietnam beroperasi di LNU pada lokasi yang jaraknya hanya 20 mil laut (sekitar 37 kilometer) dari Pulau Laut. Keberadaan kapal ikan Vietnam tersebut direkam oleh nelayan Natuna pada 27 Desember 2022 di koordinat Lon 107 55′.310, Lat 05 06′.464. Jarak 20 mil laut ini merupakan jarak yang paling dekat antara lokasi kapal ikan Vietnam dengan pulau terluar di Laut Natuna yang selama ini terdeteksi, baik menggunakan AIS, Citra Satelit maupun pertemuan langsung dengan nelayan Natuna. Titik koordinat kejadian tersebut ditunjukkan pada Gambar 5 dan Gambar 6.

Jumlah Kapal Ikan Vietnam di Laut Natuna Utara (LNU) dari Waktu ke Waktu

Jumlah kapal ikan Vietnam yang diduga kuat melakukan kegiatan illegal fishing di LNU yang terdeteksi oleh IOJI sejak tahun 2021 hingga 2022 tersaji pada grafik di bawah ini (Gambar 9).

Sebagaimana telah disampaikan pada Sub-bab 1.2., pada bulan November dan Desember 2022 tidak tersedia citra satelit dengan kualitas gambar yang baik akibat ketebalan awan. Hal ini menyebabkan perhitungan jumlah kapal ikan di kedua bulan tersebut hanya didasarkan pada deteksi AIS.

Penegakan Hukum terhadap Pelaku Illegal Fishing KIA Vietnam di Laut Natuna Utara

Tabel 3 di bawah ini menunjukkan data jumlah kapal ikan Vietnam yang ditangkap oleh Pemerintah Indonesia pada tahun 2021 dan 2022. Lebih lanjut, Gambar 10 menunjukkan jumlah kapal ikan yang dimusnahkan berdasarkan putusan pengadilan yang telah inkracht.

Berdasarkan Tabel 3 dan Gambar 10 di atas, penegakan hukum terhadap kapal ikan asing yang melakukan illegal fishing terutama yang berasal dari Vietnam mengalami penurunan sejak tahun 2019.

Patroli Kapal Vietnam Fisheries Resource Surveillance (VFRS) dan Kesepakatan Batas ZEE Indonesia-Vietnam

Meskipun Pemerintah Indonesia dan Vietnam telah menyepakati garis batas ZEE pada Desember 2022, pantauan IOJI terhadap AIS kapal VFRS menunjukkan bahwa kapal-kapal ini masih melakukan operasinya di sepanjang garis Landas Kontinen Indonesia dan Vietnam. Sejak 1 Desember 2022 sampai 4 Januari 2023 terdapat 4 kapal VFRS yang berpatroli di garis Landas Kontinen Indonesia-Vietnam yaitu kapal Kiem Ngu 264, 218, 276 dan 209. Gambar 11 berikut ini menunjukkan perlintasan dari kapal-kapal tersebut.

Meskipun pemerintah Indonesia dan Vietnam sudah menyepakati batas ZEE, faktanya hingga Desember 2022 masih marak kapal-kapal ikan Vietnam yang patut diduga kuat melakukan illegal fishing di LNU. Seharusnya, Presiden Vietnam sudah dapat menginstruksikan agar kapal-kapal VFRS yang selama ini berpatroli di garis landas kontinen Indonesia-Vietnam serta kapal-kapal ikan Vietnam yang beroperasi di area tersebut untuk mundur sampai ke belakang garis ZEE yang telah disepakati kedua negara pasca kesepakatan ZEE Indonesia-Vietnam.

Berdasarkan UNCLOS, Pemerintah Vietnam selaku negara bendera kapal memiliki kewajiban untuk memastikan agar kapal-kapal yang mengibarkan benderanya tidak terlibat dalam kegiatan IUU fishing. Fakta bahwa kapal ikan Vietnam masih marak beroperasi di garis landas kontinen dan bahkan jauh masuk ke dalam ZEE Indonesia dekat dengan Pulau Laut membuktikan bahwa Pemerintah Vietnam gagal melaksanakan kewajibannya, dan Pemerintah Indonesia seharusnya sudah dapat mengambil langkah hukum terhadap Vietnam berdasarkan UNCLOS.

Kapal China Coast Guard (CCG) 5901 dan Blok Tuna

Hanya berselang 11 hari sejak Indonesia dan Vietnam menyepakati batas ZEEnya, tepatnya pada tanggal 2 Januari 2023, Kementerian Energi dan Sumber Daya Mineral (KESDM) menyetujui Plan of Development (PoD) di Blok Tuna. Gambar 12 berikut ini menunjukkan lokasi Blok Tuna.

Pada bulan Oktober 2021, kapal Hai Yang Dizhi 10 berbendera Tiongkok beroperasi di area Blok Tuna dengan pergerakan membentuk pola “cetak sawah”.  Tidak diketahui secara pasti hingga saat ini apakah kegiatan yang patut diduga kuat adalah riset kelautan tersebut dilaksanakan dengan izin dari Pemerintah Indonesia atau tidak. Sebelumnya, pada Desember 2021, Pemerintah Tiongkok pernah menyampaikan kepada Pemerintah Indonesia untuk menghentikan kegiatan eksplorasi di Blok Tuna karena klaim nine dash line. Saat melaksanakan kegiatannya, kapal Hai Yang Dizhi 10 dikawal oleh kapal China Coast Guard.

Kapal-kapal CCG selama tahun 2022 hingga Januari 2023 terdeteksi beroperasi di perairan Laut Natuna Utara dekat dengan lokasi Blok Tuna. Rekapitulasi lokasi kapal CCG pada tahun 2022 tersaji pada Gambar 14 berikut ini.

Tabel berikut menyajikan informasi mengenai durasi kehadiran kapal CCG dan jarak kapal-kapal tersebut ke pulau terluar di Laut Natuna Utara, yaitu Pulau Laut.

Selain kelima kapal CCG yang disebutkan di dalam tabel di atas, kapal CCG 5901 juga beroperasi di Laut Natuna Utara. CCG 5901 yang merupakan kapal coast guard terbesar di dunia mulai berpatroli di Laut Natuna Utara sejak 30 Desember 2022. Kapal ini memiliki ukuran 12.000 GT dengan panjang 165 meter dan lebar 22 meter dengan kecepatan maksimal hingga 25 knot.

Pergerakan kapal CCG 5901 pada tanggal 30 Desember 2022 sampai 10 Januari 2023 tersaji pada Gambar 16 berikut ini.

CCG 5901 terpantau bergerak “mondar mandir” dan berhenti dari satu titik ke titik lain di Vanguard Bank dan ladang migas 12W Chim Sao milik Vietnam.

Pergerakan terkini CCG 5901, yaitu pada tanggal 11-19 Januari 2023 ditunjukkan pada Gambar 17 di bawah. Gambar tersebut menunjukkan CCG 5901 bergerak menuju target yang sama seperti target sebelumnya, yaitu Vanguard Bank dan ladang migas Chim Sao milik Vietnam.

UNCLOS mengatur bahwa setiap kapal memiliki kebebasan untuk berlayar di ZEE negara lain dengan beberapa pembatasan sebagai berikut:

Pertama, meski UNCLOS tidak mengatur definisi tekstual terhadap kata “navigasi” di ZEE, makna atau konteks dari kata ini dapat kita temukan dengan merujuk pada pasal-pasal lain di dalam UNCLOS. Rezim navigasi di laut teritorial (innocent passage), di perairan kepulauan (archipelagic sea lane passage), di selat untuk pelayaran internasional (transit passage) memaknai navigasi sebagai perlintasan yang cepat (expeditious) dan terus-menerus (continuous) melalui wilayah perairan negara lain. Dengan kata lain, kecuali ada alasan yang sah menurut hukum (misalnya karena force majeur atau karena menolong seseorang yang berada dalam keadaan gawat darurat di laut), perlintasan sebuah kapal di perairan negara lain harus terjadi secara cepat dan terus menerus. Makna navigasi ini juga berlaku bagi kebebasan navigasi di ZEE.

Kedua, UNCLOS mengatur mengenai kewajiban due regard yang harus dipatuhi oleh negara bendera saat kapal yang mengibarkan benderanya melintas di ZEE negara lain. Kewajiban due regard ini mewajibkan kapal yang melintas di ZEE negara lain untuk menghormati hak dari negara yang perairannya dilintasi tersebut. Bentuk penghormatan dimaksud antara lain berhati-hati dan menahan diri untuk tidak melanggar hak berdaulat dari negara yang perairannya sedang dilintasi dan, dalam hal muncul keraguan, berkonsultasi dengan itikad baik dengan negara yang perairannya sedang dilintasi.

Ketiga, UNCLOS juga mengatur mengenai kewajiban beritikad baik (good faith) dan tidak sewenang-wenang melaksanakan haknya (abuse of right). Pelaksanaan hak yang sewenang-wenang merupakan salah satu wujud dari pelanggaran good faith. Yang dimaksud dengan abuse of right adalah melaksanakan hak yang dimiliki dengan tidak wajar atau dengan tidak mengindahkan legitimate expectation dari pihak lain. Tiga bentuk abuse of right adalah: (i) pelaksanaan hak oleh satu pihak dengan cara-cara yang mengakibatkan pihak lain tidak dapat melaksanakan haknya; (ii) pelaksanaan hak oleh satu pihak dengan tujuan yang tidak sesuai dengan tujuan luhur dari hak tersebut; (iii) pelaksanaan hak oleh satu pihak yang menyebabkan kerugian pada pihak lain (Reinhold, 2013).

Perlintasan CCG 5901 sebagaimana ditunjukkan pada Gambar 18 di atas bukanlah perlintasan yang cepat dan terus menerus melintasi ZEE Indonesia dan Vietnam. CCG 5901 berkeliling dari satu titik ke titik lain dan juga berhenti pada lokasi dan periode waktu tertentu dalam rentang waktu 20 hari. Menjadi wajar dan patut jika perlintasan ini tidak dipandang sebagai pelaksanaan kebebasan berlayar, melainkan ada tujuan lain dari perlintasan yang dilakukan CCG 5901 yang berpotensi kuat melanggar prinsip-prinsip navigasi, kewajiban due regard dan good faith sebagaimana dijelaskan di atas.

Operasi Kapal Ikan Indonesia di ZEE Papua New Guinea

Pada bulan Desember 2022, IOJI mendeteksi 16 kapal ikan Indonesia (KII) yang beroperasi di ZEE Papua New Guinea. Sebelumnya, IOJI juga mendeteksi 59 KII yang sebagian besar menggunakan alat tangkap pancing cumi pada bulan Februari 2022.

Aktivitas KII di wilayah tersebut direspon oleh pemerintah Papua New Guinea dengan mengirimkan kapal patroli angkatan bersenjata HMPNGS Ted Diro 401 di bulan Agustus 2022. Pada tanggal 22 Agustus 2022, terjadi insiden penembakan oleh patroli Papua New Guinea terhadap seorang nelayan Indonesia asal Merauke yang menahkodai kapal ikan KM Calvin 02 (29 GT), yang mengakibatkan nelayan tersebut meninggal dunia. Selain itu, terdapat 2 kapal ikan Indonesia lainnya yang ditahan oleh otoritas Papua New Guinea.
