Pendahuluan
Analisis ini menguraikan pratik IUU (Illegal Unreported Unregulated) fishing yang terjadi pada kuartal-1 tahun 2021 di Laut Natuna Utara berdasarkan data AIS (Automatic Identification Systems) dan citra satelit ESA Sentinel-2. Ditemukan banyak kapal ikan Vietnam yang diduga kuat melakukan illegal fishing di Laut Natuna Utara bagian utara menggunakan dengan alat tangkap Pair Trawl. Jumlah kapal ikan Vietnam tersebut diperkirakan dapat mencapai lebih dari seratus kapal dalam satu periode waktu. Meskipun pada bulan Februari hingga April 2021 sejumlah kapal ikan asing Vietnam berhasil ditangkap oleh Kepolisian Republik Indonesia (POLRI), Badan Keamanan Laut Republik Indonesia (BAKAMLA RI) dan Kementerian Kelautan dan Perikanan (KKP), jumlah kapal yang ditangkap tersebut masih sangat kecil dibandingkan dengan jumlah keseluruhan kapal ikan asing di Laut Natuna Utara. Oleh karenanya, penguatan patroli di wilayah-wilayah laut yang rawan, khususnya Laut Natuna Utara, perlu ditingkatkan dan dilaksanakan secara sinergis oleh instansi-instansi yang memiliki tugas dan fungsi menjaga keamanan laut.

IUU fishing oleh kapal ikan Vietnam di Laut Natuna Utara pada umumnya berlangsung sejak bulan Februari s.d. Oktober setiap tahunnya. Pada bulan tersebut, Laut Natuna Utara berada dalam kondisi yang baik sehingga banyak kapal ikan Vietnam pergi melaut.
Gambar 1 menunjukkan lokasi kapal ikan Vietnam yang jelas memasuki wilayah Zona Ekonomi Eksklusif (ZEE) Indonesia di Laut Natuna Utara pada tanggal 26 dan 28 Februari 2021. Berdasarkan deteksi tersebut, 77% berada di wilayah tumpang tindih ZEE Indonesia dengan Vietnam, dan sekitar 23% berada di dalam ZEE Indonesia. Kapal-kapal ikan Vietnam selalu dikawal oleh beberapa kapal patroli perikanan Vietnam Fisheries Resources Surveillance (VFRS) di sepanjang garis Landas Kontinen Indonesia-Vietnam. Kapal-kapal VFRS tersebut diduga kuat melindungi dan memberikan informasi untuk mendukung aktivitas penangkapan ikan ilegal oleh kapal ikan Vietnam di ZEE Indonesia.

18 & 20 Maret 2021
Pada tanggal 18 dan 20 Maret 2021, Puluhan kapal ikan Vietnam masuk dan diduga kuat melakukan penangkapan ikan secara ilegal di Laut Natuna Utara sebagaimana ditunjukkan pada Gambar 2. Pada periode ini, mayoritas kapal ikan Vietnam masuk sampai ke dalam ZEE Indonesia (tidak berada di dalam area tumpang tindih klaim ZEE IndonesiaVietnam) dan diduga kuat menangkap ikan secara ilegal. Area tumpang tindih klaim ZEE Indonesia Vietnam adalah wilayah di antara garis batas landas kontinen (garis putus-putus putih) yang disepakati oleh Indonesia dan Vietnam pada tahun 2003 dan garis klaim ZEE Indonesia (garis putus-putus hitam). Wilayah laut di sebelah selatan garis Landas Kontinen (mendekati Kepulauan Riau) adalah Zona Ekonomi Eksklusif Indonesia dimana hak berdaulat Indonesia atas sumber daya ikan berlaku dan tidak ada pihak manapun yang dapat melakukan penangkapan ikan tanpa izin dari pemerintah Indonesia di wilayah tersebut. 90% kapal ikan Vietnam yang terdeteksi pada tanggal 18 dan 20 Maret 2021 berada di dalam wilayah ZEE Indonesia dan diduga kuat melakukan illegal fishing.

Perbedaan mendasar dari Gambar 1 dan Gambar 2 adalah lokasi kegiatan penangkapan ikan secara ilegal oleh kapal-kapal ikan Vietnam, dimana pada Gambar 1 mayoritas kapal berada di wilayah area tumpang tindih klaim ZEE, dan pada Gambar 2 mayoritas kapal masuk lebih jauh ke dalam ZEE Indonesia. Masuknya kapal-kapal ikan Vietnam lebih jauh ke dalam ZEE Indonesia diduga disebabkan oleh minimnya kehadiran kapal patroli pemerintah Indonesia. Meskipun Kapal patroli milik POLRI, yaitu Kapal Polisi (KP) Bisma 8001, berhasil menangkap 2 (dua) kapal ikan Vietnam 1 pada tanggal 18 Maret 2021 di Laut Natuna pada koordinat 06° 41 770′ LU – 109° 21 326′ BT (Gambar 3), jumlah kapal patroli yang ada sangat sedikit dibandingkan dengan jumlah kapal ikan Vietnam. Kapal Polisi (KP) Bisma 8001 pun tidak dapat menangkap banyak kapal ikan Vietnam secara bersamaan dalam satu waktu. Pada tanggal 20 Maret 2021, beberapa kapal ikan Vietnam terlihat kembali berada di sekitar lokasi penangkapan kapal ikan Vietnam oleh KP Bisma 8001 (Gambar 4).

Gambar 6 menunjukkan keberadaan sejumlah kapal ikan Vietnam pada tanggal 28 Maret 2021, yang diduga sedang melakukan kegiatan IUU fishing di dalam ZEE Indonesia (tidak berada di area tumpah tindih klaim ZEE Indonesia-Vietnam).

Dari sejumlah kapal yang terdeteksi, 1 (satu) kapal berukuran lebih besar daripada kapal ikan yang lainnya. Kapal ini diduga berperan sebagai kapal pengangkut ikan. Ukuran panjang kapal tersebut diperkirakan 65 meter (Gambar 7).

30 Maret 2021
Pada tanggal 30 Maret 2021 kembali terdeteksi sejumlah kapal ikan Vietnam di Laut Natuna Utara. 50% lebih kapal yang terdeteksi masuk jauh ke dalam ZEE Indonesia di luar area tumpang tindih klaim Indonesia-Vietnam (non-disputed area). Beberapa kapal ikan Vietnam masuk sampai 85 kilometer (45 nautical miles) jauhnya dari garis batas landas kontinen bagian utara perbatasan Indonesia-Vietnam.

2 April 2021
Kegiatan penangkapan ikan secara ilegal oleh kapal ikan Vietnam kembali terdeteksi pada tanggal 2 April 2021. Setidaknya terdeteksi lebih dari 100 kapal ikan Vietnam pada tanggal 2 April 2021 dimana 90% kapal berada di dalam wilayah ZEE Indonesia (sebelah selatan area tumpang tindih klaim ZEE Indonesia-Vietnam). Sisanya, 10% terdeteksi di dalam wilayah ZEE Malaysia. Kali ini, kapal-kapal ikan Vietnam masuk sampai 120 kilometer dari garis batas landas kontinen (jauh lebih dalam dibandingkan dengan lokasi kapal ikan Vietnam di bulan Maret 2021 yaitu 85 kilometer). Gambar 9 menunjukkan lokasi kapal-kapal ikan Vietnam tanggal 2 April 2021.

Gambar 10 merupakan hasil overlay lintasan kapal patroli Indonesia pada tanggal 1 Maret 2021 hingga 7 April 2021 yang digabungkan dengan citra satelit sebaran kapal ikan Vietnam. Kapal patroli Indonesia yang dimaksud adalah Kapal Nasional (KN) Pulau Dana (BAKAMLA), Kapal Polisi (KP) Bisma 8001 (POLRI) dan Orca 03 (KKP). Sebagaimana telah disampaikan di atas, KP Bisma 8001 berhasil menangkap 2 (dua) kapal ikan Vietnam pada tanggal 18 Maret 2021 di bagian utara Laut Natuna Utara tepatnya pada koordinat lokasi 06° 41 770’ LU – 109° 21 326’ BT. Sedangkan Kapal Orca 03 milik Kementerian Kelautan dan Perikanan berhasil menangkap 2 (dua) kapal ikan Vietnam pada 29 Maret 2021. Lokasi penangkapan berada di bagian barat Laut Natuna yang berbatasan dengan Malaysia tepatnya pada koordinat lokasi 03°52 413’ LU – 104°45 031’ BT.
Kapal Nasional (KN) Pulau Dana milik BAKAMLA berhasil menangkap 1 (satu) kapal ikan Vietnam pada 2 April 2021. Lokasi penangkapan tidak disebutkan dalam keterangan resmi, namun diperkirakan berada di sekitar wilayah penangkapan kapal Vietnam oleh kapal patroli Orca 03 pada 29 Maret 2021, yaitu di bagian barat Laut Natuna yang berbatasan dengan Malaysia. Jumlah kapal ikan Vietnam pelaku IUU fishing yang berhasil ditangkap oleh kapal patroli Indonesia sejak 1 Januari 2021 hingga 4 April 2021 adalah 5 (lima) kapal. Jumlah ini masih sedikit
dibandingkan dengan jumlah lebih dari seratus kapal ikan Vietnam yang diduga kuat melakukan pencurian ikan di Laut Natuna Utara. Aktivitas kapal-kapal ikan Vietnam tersebut setidaknya mencakup area laut seluas 100.000 km2 di Laut Natuna Utara dengan menggunakan alat tangkap pair trawl. Alat tangkap tersebut dikenal sebagai alat tangkap yang merusak ekosistem dasar laut dangkal seperti Laut Natuna Utara. 2
Diperkirakan dalam beberapa bulan yang akan datang kegiatan pencurian ikan oleh kapal ikan Vietnam masih akan terus berlanjut dan berpotensi semakin meningkat. Laut Natuna Utara terbukti masih menjadi incaran oleh kapal ikan Vietnam pelaku illegal fishing. Perkiraan ini didasarkan pada pengamatan dan analisis kecenderungan perilaku kapal-kapal ikan Vietnam yang terjadi sepanjang tahun. Apabila hal ini dibiarkan berlarut-larut, maka kesehatan laut dan keberlanjutan sumber daya ikan di Laut Natuna Utara sangat terancam.
Tanggal 8 April 2021, Kapal patroli Orca 03 dan beberapa kapal patroli Hiu Macan milik KKP telah berhasil menangkap 5 kapal ikan Vietnam yang menangkap cumi secara ilegal di Laut Natuna Utara. Penangkapan oleh KKP ini perlu mendapatkan apresiasi masyarakat.
Selanjutnya, patroli seperti yang pernah dilakukan oleh KP Bisma 8001, KN Pulau Dana dan Orca 03 sebagaimana diuraikan di atas perlu diintensifkan dan difokuskan ke wilayah lebih utara dengan koordinat antara 5° 12’ 00’’ LU s.d 6° 35’ 00’’ LU dan 105° 30’ 00’’ BT s.d. 109° 12’ 00’’ BT yang menjadi pusat pencurian ikan di Laut Natuna Utara. Intrusi kapal asing pelaku IUU fishing Vietnam tidak hanya beroperasi di ZEE Indonesia, namun juga beroperasi di wilayah maritim Malaysia. Berdasarkan laporan media Sinar Harian Malaysia pada 14 April 2021, Jabatan Perikanan Malaysia menyatakan bahwa intrusi nelayan asing Vietnam ke wilayah maritim Malaysia sudah dalam kondisi kritis.3 Hal ini dapat menjadi perhatian bahwa intrusi besar-besaran oleh nelayan Vietnam pada kuartal-1 tahun 2021 di Laut Natuna Utara telah mengarah ke kondisi kritis seperti yang sedang terjadi di Malaysia dan disadari oleh pemerintah Malaysia. Sejak April 2019 hingga April 2021 Malaysia telah berhasil menangkap 159 kapal ikan Vietnam ilegal dengan total 1609 ABK Vietnam di wilayah perairan yurisdiksi Malaysia.
Berdasarkan analisis di atas, kami merekomendasikan:
1. Melakukan Patroli intensif dan rutin di Laut Natuna Utara sampai ke batas terluar klaim ZEE
Indonesia.
2. Mendayagunakan BAKAMLA atau Satuan Tugas Pemberantasan Penangkapan Ikan Secara
Ilegal (Satgas 115) sebagai simpul koordinasi antar instansi keamanan laut untuk bersama –
sama secara sinergis melakukan patroli di wilayah Laut Natuna Utara.
3. Mempercepat kesepakatan penyusunan provisional arrangement (UNCLOS Pasal 74 ayat 3)
dengan pemerintah Vietnam untuk mencegah konflik di tengah laut karena pencurian ikan
yang terus menerus terjadi di wilayah ZEE Indonesia.
